Did Eric Holder Lie to Congress?

HolderOn May 15, Attorney General Eric Holder testified before the House Judiciary Committee and said this about the Justice Department’s investigation of national security leaks to journalists.

“In regard to potential prosecution of the press for the disclosure of material:  This is not something I’ve ever been involved in, heard of, or would think would be wise policy.”

Except it turns out that Holder not only heard about the potential prosecution of the press, he personally approved it.  After he testified NBC News broke the story that Holder had personally signed off on a search warrant to go after the phone and email records of James Rosen, the Fox news reporter.  The warrant accused Rosen of conspiring to publish classified material that allegedly was leaked to him for a story about North Korea.

So what should we make of Eric Holder’s testimony to the House Judiciary Committee?  Did he simply forget that he was the one who approved the request for a warrant to check Rosen’s phone records and personal emails?  Did he sign off on the warrant request but wasn’t really paying attention to what he was signing?

Anything, I guess, is possible – including this, which I think is much more likely:  Eric Holder lied to Congress, which is a federal offense.  He certainly didn’t tell the truth.

And since the president himself has said, “Journalists should not be at legal risk for doing their jobs,” the obvious question arises:  Will Eric Holder be forced to resign?

I’m saying, don’t bet on it.

For a scandal to take off and have serious political consequences it has to enter the bloodstream of the general population.  It can’t simply be something that news junkies and political partisans in Congress care about.

So Holder will need to become a running gag on late night comedy shows.  He will have to be a recurring theme on Jon Stewart’s show.  And the question of whether the Attorney General of the United States – the highest-ranking legal officer in America – lied to Congress will need to become a running story on the network evening newscasts, where some 20 million people get their news.

Only then will it truly become a scandal with political consequences.  And if all of that happens Eric Holder will have to go.

But what if this current outrage by reporters who see Holder’s actions as a threat to press freedom turns out to be nothing more than a lover’s spat between the press and the Obama administration — and soon goes away?  What if the storyline changes from “Attorney General threatens First Amendment” to “Republicans use so-called press scandal to score political points”?

Remember, too many journalists are still too cozy with this president, whom they genuinely like and respect and in whom they have so much invested.  His values are their values.  His liberalism is their liberalism.  As Rush Limbaugh says, they are one in the same.

One more thing:  How much did the Obama administrations war on Fox News play into Eric Holder’s decision to go after James Rosen?  The president and his political cronies have tried their best to convince the American people that Fox is not a legitimate news organization; that’s it’s nothing more than a wholly-owned subsidiary of the national Republican Party.

I possess no smoking gun memo from the president that says, “Go after Rosen and bring down Fox News.”  That’s not how politics works in the post-Watergate era. But is it such a leap to connect a few dots and come to the conclusion that if the president, who is especially thin-skinned, detests Fox … that his attorney general might try to hurt one of its top reporters? Even accuse him of espionage?

Just because it’s crazy doesn’t mean it didn’t happen.

    The pushback now is that he didn’t lie because he referenced “prosecution” and since he never intended to prosecute (but only investigate who was purportedly giving Rosen information), then he didn’t lie. Of course, his statement, though true, is at the very least absolutely misleading. If you ask someone if he is breaking into and rummaging through cars, and he answers, “Stealing cars is not something I’ve ever been involved in,” then you come away with the impression that he is not the guilty party. Of course, Congress wasn’t asking (solely) about prosecution but about investigating a journalist. Holder needs to go.

    Holder hasn’t lied. In his mind there is no such thing. Remember that Holder was asked what is the definition of a lie. As I recall he said it was a “state of mind”. Doesn’t that mean that anything that Holder says is made up in his mind? End of story and guilty as charged.

He’s either guilty of a: lying to Congress when he said he’d never heard of investigating journalists for possible espionage in leak investigations (paraphrased) or b: he lied to the judge when he asked for a search warrant due to possible espionage on the part of the Fox reporter. One way or the other, he lied. You can’t say he didn’t know or had never heard of such a thing when he, himself, signed off on the search warrant request and you can say he didn’t intend to actually go after the reporter for criminal misconduct if that’s what he used as a reason for the search warrant. HE LIED, there’s simply no way around it.

            I can look them up. I’ve listened to them multiple times, but can’t quote them word for word. However, you can play ‘dumb’ and pretend he didn’t lie because he never ‘intended’ to prosecute. Okay, well at the very least he played word games and misled Congress, which is pretty much the same thing as lying. Plus, if he didn’t intend to prosecute, then he lied to the judge when he went to court and claimed they were investigating the FOX reporter for possible espionage and that he was a flight risk. Obviously, that was intended to tell the judge that they were seriously considering charging him with espionage. So, while they may have been playing with words again, they basically lied to the judge as well. You can play with words all day long but if the intent is to deceive then you are LYING. Anyone who doesn’t understand that needs help with their basic character.

      Rosen didn’t publish anything that put Americans at risk. If you want to prosecute someone, start with the person(s) who allegedly leaked the information to Rosen. Assange published information that put American lives at risk.

    Did Obama LIE about his birth certificate, that should be the bigger question? His April 27th, 2011 presentation of a birth document was a forgery. Has Obama been guilty of using a fraudulent SS#, E-Veriy thnks so? Did Obama fraudulently register with the Selective Service in 2008, the evidence is pretty substantial that he did. These are much more serioius charges. If it is all true than this President has been using fraudulent documents to remain in office while we were involved in two wars. If this were back in the days of World War II he would be facing the death penalty,.

    They just needed a judge to agree that Rosen probably violated the Espionage Act
    so that they could get their warrant to read his emails, as part of their real
    investigation into his source, an intelligence analyst named Richard Kim. It

      This proves that elected politicians hold a lot of power that can be used to further their political agendas and careers. This is why the liberal press does us more disservice than these politicians. Americans need to know when the folks in power abuse that power.
      I will say repeated comparisons to Bush has gotten very old. Yeah, we know he was not the best President ever, but he is long gone from office. Referring to him so often is like saying “Oh yeah? George did this so Obama has a green light.” Like that makes what Obama and his gang are doing is OK.

      Sure I remember, Gonzalez not top Ag by any stretch. We also remember that a top AG, John Ashcroft, very honorable guy (hero to you folks when he supposedly stood up to Cheney from his hospital bed) was hounded out of office by the likes of you. We also remember NYT responsible for saving Bin Laden’s life (don’t blame Bush, they let him know his cell phone was tracked in ’99) and other leaks, real damage done. Still, even Gonzalez not so foolish as to seize phone records like this. You guys just don’t get it-if Holder gets away with this, it’s a matter of time before the Rs are in with precedent set. That what you want?

    What do I think of Obama and his administration after the Benghazi cover-up and the news about the IRS; the AP and Fox News phone records scandals are reminiscent of Richard Nixon. I recall how outraged liberals were over Watergate and about Nixon’s infamous enemies list. However no one died in the Nixon scandals.

    So…what do I think…Obama has proven that my gut feelings about him and his administration were true from the first time I heard him speak as a 2004
    keynote speaker at the Democrat convention? I have always believed that Obama is nothing more than a conman, doing what conmen do…LIE…for without lies a conman is nothing and has nothing to offer.

    His political experience (with the help from MSM, making sure the un-informed
    stayed un-informed), a cakewalk; has positioned him to destroy the Constitution and the Democrat Party’s hold on power in Congress because in the end it was never about the Party; or his swearing to defend and protect the Constitution of these United States of America. It was always about his Communist/Marxist/Socialist ideology, learned at an early age from family,
    mentors, college professors, and extreme leftist friends and colleagues.

    Both the president’s chief of staff Denis McDonough and his chief counsel Kathy Ruemmler knew in mid-April that an IRS Inspector General’s report critical of the way the agency handled conservative applications was due out any day. But they chose not to tell the president — or that’s the official story anyway. If true, then Obama is no more than a puppet of his handlers. But either way Obama has plausible deniability, because they all will lie. However, in any case he should be held accountable; after all isn’t he the President… and should bear the “ultimate responsibility” for the actions of his subordinates.

    If Holder didn’t lie to congress, then he lied on the affidavit to the judge. And if he didn’t lie to the judge in his warrant affidavit, then he did lie to congress. Also, I thought it illegal to judge shop a search warrant request. But since the Obama administration has been having their cake and eating it too, I doubt much will come of this. Unless the press decides to stop ogling the beauty queen administration and start doing their jobs. I never mind it when they give a republican a hard time, they are keeping them honest. I do wish they would do their jobs here. This is possibly the most dangerous time for our country in living memory. The danger so insidious. No way a Bush or McCain or Romney administration skates along like this. No way.

    The oath of office has the words “support AND defend the Constitution against all enemies foreign and DOMESTIC” {emphasis mine}. So to extrapolate When Eric Holder lied to Congress it wasn’t anything new…He did the same during his last oath ceremony as AG…My opinion, it wasn’t the first time either, every time the man opens his mouth he lies!!!!. This one is provably, therefore in most jurisdictions all past decisions become suspect such as a crime lab technician deliberately falsifying DNA data. All previous cases that individual worked on must be reviewed for accuracy. By lying to Congress Eric Holder has called into question any decision that he has been associated with and by my definition HE has become a domestic enemy of the United States.

Republicans are brain dead when it comes to investigations and if they did’t swear in Holder it proves my point. If he was sworn in he lied under oath and isn’t that a crime deserving of a punishment more than forced resignation for crying out loud. Didn’t they swear the baseball players in before they gave their testimonies DOJ? The more I watch this scandal the more the scandal seems to involve those conducting the investigation.       A special prosecutor is just what Obama and Holder are hoping for. The administration would clam up saying “we can’t comment because of the ongoing investigation”. Who would get to pick the “special” prosecutor, Mr. Holder, Mr. Obama, or Jay Carney (the Artful Dodger)? And while the “special” prosecutor was gathering evidence and being stone walled for months, the story quickly fades from the headlines and six to 12 months from now, it’s old news and nobody cares any more. Let the committee continue its investigation and subpoena those “rogue” IRS functionaries from the Cincinnati IRS office, question them under oath and giving them immunity if necessary to find out if they were told to target conservative groups seeking tax exempt status with audits or unusual questioning and/or delays in granting such approvals. Let’s see how far up the chain of command this wrong doing goes.

    When an American President chose to parse the verb; ‘to be’, “…what is is…”, we have witnessed the value of language plummet. The simplest of terms would lead Roget into tail-spin. Thus “(sic) would suggest researching in depth – and maybe loft. So how should we parse the verb “lie” or even the noun “lie”. In an administration that gained its ground by rhetoric alone (as only on rhetoric sans virtue), should we not just judge an attorney generals words as mere art or temporary means.
    Orwell opined; “In an age of universal deceit, telling the truth will be an revolutionary act.” Perhaps we can paraphrase…’how we value the truth might be a revolutionary factor.’

        I would like Bernie to go back to the first emergence of Obama as a senator and read the statements he has made and determine if they were the truth or lies. I would also like to see the times he condemned the Republicans for something he later did himself. His rips into Romney were usually unabashed lies, none of them challenged by the liberal media.

    Little doubt Holder and Obama lie as a matter of course. But he’s not going to prosecute himself and Holder and Obama are like two peas in a pod. Also in that pod are most members of the media who think it’s OK to go after Fox — a major competitor and owner of the Right. They think it’s OK to go after conservatives with the IRS. Also in that pod is the entire educational, entertainment and most of the government-sponsored and financed non-profit industries. Obama will stay, Holder will stay, and maybe run for Prexy as Obama’s proxy if Michelle can’t and if Obama doesn’t change the law to run or remain. Anything’s possible with this pea pod.

Their insurance is gone TODAY, where are the exchanges TODAY? I seem to remember that Obamacare was not going to increase the federal income taxes of anyone making less than $200,000 a year. Going back a little further, I remember when Obama said Obamacare wasn’t going to be paid for by taxes. Maybe you don’t mind paying more taxes to provide health insurance to those who can’t or won’t pay for their own, after all, you’ve got that big stock portfolio. I do all I can to provide for my own family; let everyone else do the same.
            Bush’s mess? After five years you are still blaming Bush? How cliché. Obama added more to the national debt in four years than Bush did in eight. Five years and we still don’t have a budget. the three budgets Obama submitted didn’t get a single Democrat vote. the House has submitted several suggested budgets to the Senate and Harry Reid declares them all ‘dead on arrival’; he won’t even schedule them for debate. without a budget Obama feels he can’t be held accountable for living within a budget.

            All of this goes back to the problems of a deteriorating society. We started losing back in the 60′s. The slow response to the drug culture and the loss of basic morality. Had we hit these issues hard, we wouldn’t be in the fix we are today. The 60′s radicals are today’s morally deficient liberal leaders and their warped offspring. Generational welfare and food stamps and section 8. These are the people Obama and his ilk love. The lazy, disfunctional underachievers of our society. When this country was first colonized, if you didn’t work you didn’t eat. These aren’t the sick, the mentally challenged, the unemployable. Those people are what government aid was for, but the huge majority of welfare and goverment aid goes to people who have destroyed themselves through drugs or alcohol, or pure laziness.

MSNBC is greatly improved – Maddow and Shultz deliver well-researched material…both are very courteous to GOP guests. Yes, Fox has shown signs of late of being the fair and balanced station it was (pretty much) up to say, 2004. And they do have Chris Wallace do his thing. And sometimes Baier and O’Reilly get mad at the parrot puppets they have to deal with. O’Reilly told malkin to take a hike; got totally fed up with Palin. I once saw him tell Ingraham to get off that ideologue tip on his show! it was great!!! Fox has thebig bux behind them – and about 350 35 year old blonde women in front of them – and yes, for a very professional delivery of “neutral” news they are fine. Forgot to mention, Ailes can impress by kicking out Beck and by temporarily kicking out Rove and Morris after their blunders. AND after Mrs. Giffords got show….he told his people/hosts to be more professional and literate. I recommend watching Maddow and O’Donnell and Chris Hayes and also watching Wallace on the weekend and O’Reilly for 5-10 minutes per nite.

        Bernie and Bill O’Reilly have attempted to cover for this Fraud more times than I can count. With these present day scandals it seems it is too much for Bernie and Bill to ignore. They have go out of their way to slander and call people names who dare speak about the fraud and criminal activity that has been going on with Barack H. Obama right in the middle of it. There is a two year on going criminal investigation that has been on the fast track as of late and neither Bernie nor Bill nor anyone at Fox who has ever mentioned the investigation. The investigation is focused on three fraudulent documents that Obama has been using to enable him to remain in power. He is Commander in Chief of the most powerful military in the world for crying out loud and they deem this investigation not worthy of any coverage. This has got to blow your mind, right? Damn right I am whining and attacking the writer, he has a platform and refuses to use it. Telling us that the press won’t touch it is a very lame excuse for not functioning as a journalist. Do you job and let the readers/listeners decide.
        There is a good chance I will be shut down before Bernie gives a valid excuse for not covering this scandal of the century.

    The amazing thing to me is how after 5 years in office, Obama is not held responsible for anything. He continues his perpetual “campaign” and never actually “governs” or takes a position on anything. It’s like all those times he voted “present” in the Illinois Legislature. The media is ok with it and his supporters are ok with it. Not just the uneducated supporters but, also the wealthy, educated elites who support him. No one cares about he country, they only seem to care about their progressive agenda. It reminds me of when Bill Clinton was found to have abused countless women, the women’s groups were silent because he was advancing their agenda … so, they really didn’t care about the women … they only cared about their “agenda”. Today, the Liberals don’t care about the lying, the incompetence, the attacks upon the media, the IRS being “used” for politics, the “gun-running” and the assaults upon our personal freedoms and the U.S. Constitution … they only care about advancing the agenda. I wonder how good their memory will be when they are out of power.

          Bush got Congress’s approval on the Iraq war. I think it was a mistake, but he did not act alone.
          Obama takes no credit for negative things. Even if he did not cause these things personally, he is a lousy leader for not standing up and saying he is responsible, firing people under him and correcting mistakes.
          Let’s face it, Obama thought being President was going to one big love-fest party. He hates having to deal with negative issues other than talk on TV and get his picture taken.

      His supporters care only if Obama embarrasses them. As soon as Obama started using words like “enemy” to refer to folks that disagree with him, people took sides. When people take sides they have a hard time switching over. A cleaver strategy from Obama. So, all he has to do is not embarrass people on his side and they will forgive everything.
      Other Presidents tried to be fair and be a President for all. Most people only took sides on issues, not the President himself. It’s easy to switch loyalties that way. Again, Obama may not be much of a President, but he is a very good politician by keeping his popularity up (while the GOP tries to figure itself out).
      Obama will sell Holder out in a heartbeat.

    What really comes to mind is Holder is the “top cop” of this Nation. Obviiously he lied in May as afterall he signed the warrant so he had to of known. Now if Holder so blatantly can lie about this issue what about all the other issues? Like Fast and Furious did he also lie about that? I think with this revelation no citizen will have any faith in the DOJ as Holder has placed a really dark cloud of mistrust over the agency and therefore must go.

      Gblandy you are measuring our country by your values. As are Republicans, Conservative and Tea Parties. The Progressives do not believe in those values and ignore them. They use their own values, if that word can even be used. The voters are for the most part kept ignorant. The Progressives have won, we have lost our country.

    I don’t know, Bernie, they just may be able to weather the storm but, when HuffPo headlines that he has to go and NBC breaks the story about Holder signing off on Rosen well…
    Mind you, this country is chock full of ignorant voters. Reports like this, even in the LSM, are tuned out by a vast majority. They don’t get the implication of what Holder was doing nor do the get the implication of what the IRS was doing!
    These things are just not “shiny” enough to garner much attention.

    Virtually all of the media is missing what may be the most significant point of this entire affair. If Eric Holder signed an affidavit, which I understand he did, to support the DOJ’s attempt to obtain a subpoena or search warrant for James Rosen’s records, he committed perjury no different than if he had been put on a witness stand, swore to tell the truth and then blatantly lied in court.

    The affidavit that the DOJ used to obtain the subpoena was filled with lies, not the least of which was their claim that Rosen was being considered for criminal prosecution. They never intended to prosecute him, they used this canard to mislead a federal judge to obtain an illegal, invalid subpoena and, if Holder, or whoever it was, signed it, that person should be disbarred and jailed.

    If memory serves me correctly, and I may be wrong about this but I don’t believe so, this is precisely what caused the State of Arkansas to disbar the convicted Liar-In-Chief, Bill Clinton.
