To quote Bill Barr from his Face the Nation interview concerning Trump “He’s like a defiant 9-year-old kid who is always pushing the glass towards the edge of the table, defying his parents from stopping him from doing it,” Mr. Barr said, adding that “our country can’t be a therapy session for a troubled man like this.” I could say I'd rather vote for a trash panda wearing a thong than vote for Trump again, but that too closely resembles the current Commander in Chief. Oy...

There is a comical story of Andrew Jackson who had a parrot he apparently taught to cuss. The parrot was at Jackson’s funeral and had to be removed because the parrot began cussing up a storm. I think Trump needs a good memorable defense for the ages. Like maybe Abe Lincoln’s ghost made him do it, or he believes he is Julius Caesar. We all know he’s nuts. Might as well go out with a bang.

Under federal statute, to successfully use the insanity defense it must be proved that "the defendant, as a result of a severe mental disease or defect, was unable to appreciate the nature and quality or the wrongfulness of his acts. Mental disease or defect does not otherwise constitute a defense. "

That's the long and short of it. If I'm not mistaken, the federal insanity defense statute was tightened after the insanity finding of the guy who shot President Reagan.

Trump's own words belie an insanity defense. That's just for starters.

It would be a better defense that his constitutional right to effective assistance of counsel is denied because no one will defend him. In that case, the judge might order the federal public defenders to represent him, assuming the judge has the authority to waive the financial requirement and assuming the PD doesn't have a conflict of interest.

Trump's lawyer may say he is unfit to stand trial. That's probably his best shot. But this simply delays trial(s) and subjects Trump to all kinds of requirements.

A constitutional test may come of this.

Of course. But a lot of readers may well take it seriously. Moreover, this is a serious topic. Taking Trump to trial on the basis I outlined - along with all the other bases. A constitutional test looms.

I'll tell you a secret - I got a good chuckle out of Bernie's reply. The more likes he gets the merrier.
